This Site, our mobile App, as well as other online channels and social media including but not limited to our Facebook and Instagram pages, or any other subdomains (collectively, the “Site” “website”) are operated by Jurne Di Mare Travel, LLC (d/b/a “JDMT”, “Company,” “agent”, “We,” “us", or “our”). These Terms and Conditions apply to you here referred to as “user” (“the user”, “you”, “yours”, “yourself”, “the traveler”, “passenger”, “recipient” or “guest”) and collectively (“users”) and the use or access to our website and services of www.jurnedimaretravel.com, and any successor website of Jurne Di Mare travel, L.L.C, d/b/a “JDMT”. Service(s) made available through the Site, including (promotional marketing, travel consultations, travel planning, travel offers, tours & vacation packages pre/post, special interest travel groups, corporate business travel, travel documentation assistance services, tours or activities, etc.) collectively with the Site means (the “Services”). Much of the information of products and services on the Site is supplied by third party providers, “Jurne Di Mare Travel,” or “JDMT,” accepts no responsibility for any errors omissions, inaccuracies, or misleading statements which may appear anywhere on our site (s), whether or not, supplied by third party providers. By continuing you are agreeing to these Terms and Conditions agreement between you and Jurne Di Mare Travel L.LC, d/b/a JDMT.
Third Party Provider which refers but not limited to cruise lines, airlines, hotels, trains, ferries, tour operators, car rental companies, travel insurance service providers, sports equipment retailers, accessories manufacturers, travel advisory links, are all examples of third-party providers. We, Jurne Di Mare Travel, LLC, ( “JDMT”) have no control over the information provided by third party providers or in their platform sites, and therefore, We are not responsible nor liable for their failure to perform, or for breach of contract, or any actions, or lack of it, intentional or negligent, which results in any loss of material or life, injury, delay or damage to you or your property or to anyone traveling with you, or to the property of your traveling companion(s). Risk and responsibilities rest with the traveler, passenger or user of the services only. By accepting the Terms, you are agreeing that JDMT is not responsible or liable for any situations that may arise from the use of Third-party services. JDMT, cannot and does not guarantee Third party provider reservations, timeliness, employee conduct. We cannot guarantee nor control prices on this site as it is determined by third party providers. We are not responsible for their performance of scheduled flights, deviations, modifications, cruises, tours activity change, availability of hotels rooms, types of rooms, rental vehicle types, train accommodations, tour operator services, nor products offered via other Third-party promotions on our site.
You acknowledge and agree that upon receipt of fares by third party provider, you are using third party websites platform and that any personal information you enter is subject to privacy policy and terms of service listed on third-party websites platform. We encourage you to carefully review the third-party terms and privacy policies on those platforms before providing your private personal information. Reliance on any information provided by the Site is solely at your own risk.
You acknowledge and agree that Jurne Di Mare Travel is not liable for damages to property or bodily injury, death. Jurne Di Mare Travel shall not be liable to you for any special, consequential and/or punitive damages resulting from either Jurne Di Mare Travel or any third-party negligence, gross negligence, breach of contract, fraud, or any other causes. By agreeing to these terms, you also agree to waive any claims for damages which you otherwise might be entitled to assert against us for damage to or loss of property, death or bodily injury when the damages are covered by insurance carrier. Furthermore, you agree no insurance company, or any other third-party service provider shall ever be entitled to assert any claim(s) against Jurne Di Mare Travel, by subrogation, assignment, or otherwise.
BY CLICKING, YOU INDICATE THE ACCEPTANCE OF THESE TERMS OR OTHERWISE USING THE SERVICES. YOU AGREE TO THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU ARE ACCESSING OR USING OUR SERVICES ON BEHALF OF ANOTHER PERSON (SUCH AS USING THE SERVICES TO BOOK TRAVEL FOR MULTIPLE PEOPLE OR GROUPS, OR COMPANY) YOU REPRESENT THAT YOU ARE AUTHORIZED TO ACCEPT THESE TERMS ON THAT PERSON OR GROUP OR COMPANY’S BEHALF. IF ANYTHING IN THESE TERMS DOES NOT MAKE SENSE TO YOU, PLEASE REFRAIN FROM ACCESSING OR USING THIS SITE.
Passenger(s) are required to immediately review and verify all content and aspects of their booking (but not limited to): LEGAL passenger Firs/Last name, mailing address, email address, DOB, telephone number, pricing, airfare details, related flight information specifics, arrival/departure airports, accommodations, dietary needs, medical needs requirement, visa or passport information or other, form of entry documentation requirements and any schedule organized activities on your booking confirmation, including any cancellation rules of any of these mentioned. If you noticed any omissions and/or corrections are needed PLEASE, notify JDMT immediately. Passenger(s) assume full responsibility for any and all risks, and for administrative cost/fees related to any change, failure to report such errors and/or omissions. It is mandatory for booking travel reservations that guest names be identical to the Passenger (s) Legal first/last names.
Passenger(s) are responsible for having all travel documentation requirements in order, including passport, visa or other forms of entry required by each destination or country that passenger(s) are planning to visit. IF you require assistance completing these forms, please don’t hesitate to contact JDMT. Assistance with completing travel documentation is provided in exchange for a service fee of $30USD. Please visit the services pricing section on terms & conditions. Passenger(s) assumes sole responsibility for, and hereby releases Jurne Di Mare Travel from any claims, responsibilities from any liability, and all kinds of damages incurred as a result of Passenger(s) failure to comply with applicable documentation requirements or for providing incorrect information at the time seeking documentation assistance, including but not limited to, the responsibility of passenger(s) to ensure all passports have at least six months validity from the time of departure and return, as well as, to ensure all passenger(s) carry their travel documents with them at all times while traveling or when engaging in any travel related activities. We recommend that passengers become familiar with the proper domestic and foreign governmental agencies to be informed of all documentation requirements before initiating any travel. It is the responsibility of the traveler/passenger/guest to inform the third-party provider of any physical limitations whether refers to you or other traveler companions. Allowing Third party service providers to make any and all efforts in providing most suitable accommodations for you or your family, such us in the case (wheelchair, or mobility impediments, disabilities, etc.,). It is also your responsibility to bring your own specific medical device and/or medical equipment when traveling, regardless of the destination, or the type of travel method arrangement. Upon the receipt of your bookings or reservation confirmation the recipient should contact the service provider directly to inform or request specific accommodations whether it refers to the (airline reservation, cruise line booking, train, ferries, hotels, car rentals, etc.) Jurne Di Mare Travel will always try to do our best in assisting you with the request, however, the responsibility of informing Third party service provider with regards to health or physical limitations conditions rest solely with you, the user, traveler, guest or person who requested the reservation via us. We assume no responsibility or liability related to this matter whatsoever. It is your responsibility to ensure providers have special accommodation for you. In addition, we recommend that all travelers, passengers, guests, consult with their medical professional prior to making booking reservation and seeking travel assistance through us.
Please note, that Suppliers often reserve the right to reject any passengers whose mental state, or physical condition may interfere with itineraries or in the case accommodations are not feasible, or for any other reason. You, the traveler(s), passenger(s), guest(s), assume all risk of travel, transportation, handling of passenger’s baggage, modifications to your travel itineraries, and any travel related cost, deviations due to health conditions. Service providers also reserve the right to deviate from direct or customary scheduled routes, itineraries, etc., without limitation, or without previous notice. Passenger, traveler, guest agree that Jurne Di Mare Travel is not responsible, nor liable for any delays, deviations, cancellations, mandates, missed connections flights or any other condition beyond our control.
We all understand the need for “family time vacations” no matter what personal or physical situations we have in our lives. We all deserve to enjoy ourselves and have a great time. SAFELY! In situations where a mom is expecting, we request that you always consult with your doctor prior to requesting travel and prior to have confirmations sent. This applies to any other health conditions you may or may not have, or your companion travelers, guest, passenger(s). Jurne Di Mare Travel is not responsible for situations where passengers/travelers are unable to make the trip due to pregnancy or any other health conditions that leads to cancellations or modification of travel previously arranged. Please check with the doctor first before seeking our services. Any cost related to reservations previously booked, modifications, cancellations of any kind caused by circumstances related to the above but not limited to, or any type of travel services previously arranged for you that now has incur in cancellations will carry Nonrefundable fees and penalties imposed by Third party service providers. In addition, we as travel agents and partners are required to inform the service provider (e.g., cruises) during initial booking requests in case of emergency.
All minors under 18 years of age MUST be accompanied by a Legal guardian, and/or Parent when traveling. It is the responsibility of the Legal Guardian/Parent to inform the service provider, so that you are booked as required by (airlines, cruise lines, etc.) Minors under 18 years of age are not allowed to request travel services through us without parental consent, or adult supervision. We do not share minors’ information details for any other purpose except to complete your reservation with service provider.
We understand certain events may happen in life that cause you, the traveler(s), passenger(s), guest(s) to not proceed with your reservations, or booking itineraries previously purchased using our services. We also understand Third- party service providers often have their own cancellation policies in place. Jurne Di Mare Travel has no control over any regulated or unregulated procedure cancellations policies by Third-party service providers. It is your responsibility to review your travel booking confirmations and be aware of cancellation deadlines. Additionally, JDMT has its own cancellation fees that will apply for any previously purchased service rendered by us. This fee is non-refundable.
Cancellations fee of $50USD per person will apply depending on the travel service product arranged for you and segments. ALL cancellations are subject to our agency non-refundable cancelation fee $50pp and Third- party provider cancellation penalties such in the case of past final deadlines or fare restrictions, (airlines, cruise lines, vehicle rentals, hotels, etc.) Please note, there may be instances where the entire trip is Non-Refundable, such as the case of promotional offers, special restrictive rates imposed by airlines, past final due dates, or any other reason. You acknowledge and agree that in case of any cancellations you will be responsible for paying any travel-related extra costs.
Acceptable methods of payment: VISA, American Express, Discover, Mastercard. Prices shown are in U.S Dollars. For your convenience we may include installment payment plan with automated withdrawal amounts for your specific trip. Amounts and dates of withdrawal from your preferred method of payment will show on your invoice at check out or on your check out shopping cart. Any questions, or inquiries please email us immediately before the payment due date or if you need to change your payment method. All deposits and payments must be received by Jurne Di Mare Travel upon making your reservation, on or before the deposit due date, otherwise, your reservation will be cancelled automatically. If you have any questions, please contact us via email, e: reservations@jurnedimaretravel.com You agree to hold JDMT harmless in case your booking/reservation cancels for reasons due to either late or lack of payment or declined status of any credit card, or cancelation due to insufficient funds.
*THIRD PARTY CREDIT CARDS may or may not be accepted. In the case we do, only by completing, signing, and faxing a Credit card Authorization Form to us, signed by the credit card holder, with copies of the credit card front/back, and valid government picture ID, e.g. (Driver License/ or passport) will be valid forms of identification. We reserve the right to reject proceeding with making a reservation/booking and with the process of credit card if we suspect any fraudulent use or intentions on behalf of the user.
Both the owner of the credit card and the requester (the holder of credit card information) or any involved person requesting the booking or services, must be previously AUTHORIZED by the owner of the credit card in order to use the credit card for booking reservations with us. You have agreed to hold Jurne Di Mare Travel harmless of any/all liability and damages arising from the outcome which may result in the cancellation of your reservations/bookings, whether partially or in full, and in the event of chargebacks.
Hereby you further agree to pay any outstanding fees that may arise from it, and /or in the event of chargebacks, that you, the client/traveler(s), authorized credit card holder, will not dispute the charge that you previously authorized to make your booking. You are responsible for any related out of pocket fees due to chargebacks disputes. It is in the passenger(s) best interest as an authorized user to ensure that credit card information is correct and that it has a valid expiration date, that the number on the credit card(s) they are providing to us is the same as what it shows on the credit card on hand. You agree to hold JDMT harmless for any and all outcomes in the event of cancellations, delays, or any other schedule itinerary issue, modifications, or problems with booking confirmations, as result of providing us incorrect credit card information. You will be responsible for any related costs.
By entering into this Sale transaction service agreement, you acknowledge and agree that Jurne Di Mare Travel LLC acts as travel agent intermediary only. We are the intermediary between the client (you or any other person you are booking for) and the supplier/vendor/or entity providing services. The only obligation from us to you is to make the booking and provide you with confirmation for services you have requested, arranging travel services between you and the Service provider (cruise, airline, hotel, tour operator, etc.) Once we have made travel arrangements for you, we have completed our fulfillment of the service to you, which we are obliged to provide per the terms of this agreement. Occasionally we may offer to assist any of our valued clients with your prior consent if you need assistance, however, it will not be the rule.
All payments received by Jurne Di Mare Travel from you are to cover the cost of travel services you requested and are received as agent intermediary between you and the Service provider. If for any reason any Service provider is unable to provide services for which you have contracted, your remedy remains with the Service provider and not with us. In the event that the payment has been made to us using a credit card whether the credit card belongs to you or to a third party (*), you agree that you will not seek to chargeback or intent to recover your payment or any losses from JDMT, us.
All PRICES ARE SUBJECT TO CHANGE, until reservations are paid in full. Please note that airfares, hotels, tours and any other travel related service rates are subject to change by Third Party service provider(s) with or without advance notice. JDMT cannot guarantee prices until your reservation(s) are paid in full and upon receiving confirmation of booking by supplier/vendor. Suppliers reserve the right to not honor any published price if it determines were erroneous due to electronic, printing or clerical error, or travel restrictions. You ACKNOWLEDGE this right and agree to hold Jurne Di Mare Travel harmless for any actions, inactions, changes or damages arising from Supplier pricing errors whether electronic errors, clerical errors, or any other price change restriction. AIRLINE TICKETS are highly restrictive and may not be refundable, nor transferable, nor used as future credit. In the event we provide you with airline reservations at your request, please note that it is your responsibility to verify airfare rules with the airline carrier before traveling. If an airline cancels, modifies, deviate flights, or delays your flight for any reason, you must work with the airline carrier directly. We are not responsible for refunds of any kind, due to changes that the airline or you may have caused, whether due to airline cancellation of flight, weather conditions, mechanical failures, trip modifications, delays, deviations of any kind. In addition, we are not responsible for damage to luggage, or loss, misplaced or any type of loss of equipment that is personal/private property or not or any property that belongs to your travel companion(s). You agree hereby to hold JDMT harmless of any liability related to the above, and you also agree you are solely responsible for any costs related to any changes with air (cruise related pre-post packages, pre/post package hotels, ground transportations, etc.) You agree to confirm all bookings with the airline carrier prior to your scheduled departure date, and to pay for any related cost due to aforementioned reasons.
You also agree to directly work with the airline carrier to provide your frequent flier or any loyalty member miles, we are not responsible for relating or modifying any information regarding frequent flier miles or loyalty miles.
We strive to bring you the best service and quality results with all products we present to you when planning and researching hotel accommodations (lodging) by comparing prices and product quality by providing you with our best recommendations when booking hotels, cruise cabin bookings, vacation home rentals, Airbnb, etc. Although we make our best effort to thoroughly read and research hotel properties (or any type of) other accommodations, ultimately you make the final decision. Keep in mind accommodations designations may vary by type of lodging, location, region, country, etc. We make no guarantees about sustainability, nor availability of accommodation, or physical structural state of the property. We make every effort in assisting you if you find yourself in these situations by bringing you comparable results, however, you are responsible for bearing the extra cost of accommodation upgrades, or related lodging costs and changes in accommodations due to any unforeseen event, whether known to us or not. We reserve the right to replace the planned hotel accommodations of similar type and category in cases of Force Majeure, unforeseen events, negligence from actions by third party provider.
FORCE MAJEURE- Jurne Di Mare Travel is not liable for not being able to perform its duties nor obligations under this agreement under any period in which such performance is prevented due to Force Majeure or any unforeseen events whether it is mentioned by name on these Terms or not. Jurne Di mare Travel shall not be liable to any traveler/passenger for the need to cancel, modify, or postpone travel as a result of circumstances and/or events that are beyond our control. Jurne Di Mare Travel is not responsible and shall not be liable to any traveler for any destination-imposed travel or entry requirement(s) related to COVID-19, including but not limited to vaccinations, testing, or other public health requirements. You agree to hold Jurne Di Mare Travel harmless of any and all liabilities due to unforeseen events, whether natural or unnatural, men made or not. Force Majeure include: unforeseen events or, Acts of God, that may or may not include, natural disasters such us but not limited to: floods, fires, earthquakes, hurricanes, tsunamis, tornados, volcanic activity, riots, sabotage, civil unrest, terrorist threats, strikes, war or invasion, any government orders, or military action, COVID-19 or issues related to COVID-19, pandemic disease, any sanctions, actual or potential quarantines, or restrictions affecting travel, chemical or radioactive contamination, are all samples of Force Majeure events, and others not included on this list.
Unforeseen events can happen any time, even when you are vacationing or traveling for business. We encourage our clients to always have travel protection insurance while they are traveling to cover for those unexpected situations. While we offer travel protection through certain travel insurance providers, it is not feasible for us to compare the content of every travel insurance policy. You are responsible for doing your homework, by comparing the most suitable travel insurance coverage package for you and your family. JDMT, as your travel agent advisor, merely advises you of the need to have the coverage while you are away from home. Once you do purchase your travel insurance, we recommend you keep a copy with you at all times during your trip. Always keep note of important phone numbers so that you have them handy in case of an emergency. Any claims or reimbursements you need to contact your travel insurance provider directly, regardless of whether you purchase this through us or on your own.
Declining travel insurance coverage not only puts you and your family at risk, but you are waiving the right to be covered for losses, therefore, you ACCEPT liability for any cancellation penalties, damages, out of pocket expenses you may incur. JDMT is not responsible for any related costs, including flights delays, deviations, loss of personal property (luggage or equipment), flight cancellation tickets refunds, or any other related to the loss of materials, physical loss of life, or property.
We reserve the right to charge passenger(s) for any tax increases, airline fees, or surcharges due to (i.e., Fuel) prices imposed by airlines, governmental agencies, airports, or any other service provider fees, whether domestic or foreign entities. These types of fees are often to cover the cost for federal and government-imposed landing fees, security fees, energy and fuel increases. Passenger(s) Client agrees to pay for any/all additional costs related to changes to taxes, fees, or any related surcharges.
All online reservations will include a non-refundable service fee of $50USD per traveler. The fee covers our services. If you previously request our assistance with your travel planning, this fee also covers for the time researching the best prices and routes available for you, e.g. (flight changes, destination changes, date, departure/destination cities, hotels, cruise, pre/post packages, rental vehicles, train schedules, etc.). By bringing this service we assist the traveler and save you the time in doing research on your behalf. (Additional taxes, fees/or penalties may apply when making any type of changes to a reservation) all subject to Third Party service providers. Researching on your own can be very time consuming. When making travel plans, also travel agents have access to discounted rates, and special offers, packages, etc. We will always offer you the best discounted prices available, subject to (Third party service provider rates, promotions, restrictions, etc.)
Our travel planning will include the service of doing complex and in-depth research of your travel destination, plus all activities you may like to include, such as reading hotel reviews for you, researching available activities, tours, excursions, transportation schedules, etc., to personalize your travel experience. When customizing your travel itineraries, we will always work (one on one) with you thus enhancing your travel experience from the very start, saving you the time and stress of doing the hard work for you. This price will be included with your quote in your proposal. Customizable travel services (are non-refundable fee).
Travel Documentation assistance – for your convenience we provide assistance filling out passport application for renewals (U.S passport only), $30USD “non-refundable fee” per applicant. Please note, this fee is to cover our time in filling out your application online and no other service is included. Additional processing fees will apply imposed by the US passport office or professional service provider you chose to select. The requester is responsible for providing all correct/accurate information at the time service is requested. We will only provide this service directly to the person that requires the paperwork and not any other third-party person unless is authorized in writing with a valid government picture ID. This service includes only filling out application documents online which later will be sent to the recipient via secure email to print and mail for further processing. Recipient’s or traveler’s responsibility to mail all the required documentation to the applicable government agency or authorized personnel for processing. We are not responsible for any delays in document processing or mailing documents. Responsibility to submit and mail all required documentation rests with the original requester of our service. You authorize us to collect and store information about you and the devices you use, including the location information of your mobile phone, to access the Site, an App or provide you with requested service. You also consent to allowing the location information of your mobile phone to be used by us. As it is necessary, we share information of your location with service providers or third parties to fulfill a travel request for you, such as in the case of arranging ground transportation, pick up/drop off location, or notifying the hotel of arrivals and departures time and date as stated hereby. You authorize us to collect your device details and location information to complete us identify you in order to help complete your request and to prevent fraud. You may receive electronic notifications occasionally such as secured encrypted Email, SMS or MMS text messages from Jurne Di Mare Travel, d/b/a JDMT regarding your booking information confirmation, etc. You acknowledge and understand the message content may include inquiry responses, booking or reservation confirmations, marketing, promotional products, proposals, by using an automatic telephone dialing system, or other messaging technology system. Message/data rates may apply. Even if your contact telephone number is listed as a Do Not call, you are given your consent to us to receive text messages SMS/MMS via your mobile. You may Opt-Out withdraw your consent at any time by replying STOP, to any of our messages, or contacting us directly. We collect personal information with the sole purpose of making your reservation or assisting with a request for service from you. The personal information we collect from you may include your name, address, phone numbers, location, email address, credit card detail information, dietary, or health information, passport/travel documentation, or any other relevant information you volunteer to provide to us in order to make your booking reservations. At times, it is necessary for us to relate personal information with third party service providers (cruise, hotels, airline, tour operators, insurance providers, restaurants, and commercial partners) to arrange accommodations on your behalf or assist you with passport documentation. We do not disclose your personal information for any other purpose without your consent, except in the event it is required and necessary to disclose under the Law. The addressee of this notice will be the only recipient of this booking confirmation and terms and conditions. It is the sole responsibility of the addressee to inform and share with all other travelers in your group of the content of these terms and conditions. By accepting this receipt and making payment to JDMT, You the traveler and requester acknowledges you have been advised of these Terms and you have read, reviewed and shared with your traveling companion(s), hereby accepting these terms and conditions and contract for travel related services for all the traveler’s person, group, company’s behalf.
Please note that when you create your user login ID on any of our sites this information is confidential to you the user, you may not share login information with anyone. You understand that any person with your username and password will be able to access and use your account to request services. Including access to signup data and personal information associated with your accounts, as result, you may not share your USER LOGIN ID /PASSWORD, NOR ANY ACCOUNT DETAILS with ANY OTHER PERSON. You ACKNOWLEDGE AND AGREE hereby to all information described above, but not limited to unauthorized LOGIN access.

IF you suspect of any security breaches related to your user account or information has occurred, please notify us immediately: info@jurnedimaretravel.com (add SECURITY on the email subject).
Eligibility User Account: By using the Services you represent and warrant that:
a) You are not identified on the Office of Foreign Assets Controls Specially Designated National List (“SDN List”)
b) You are not placed on the US Department of Commerce’s Denied Persons List or Entity List or any other not placed on the US export control list.
c) You will not use IP proxying or other methods to disguise the place of your residence.
d) You have not previously had your rights to access or use the Services suspended or terminated.
e) You are not a minor under 18 years of age.
We may terminate, disable, or restrict your access to, or use of the Services at any time without notice for any reason, with or without cause at our sole discretion. We reserve the right to modify or discontinue the Service at any time, including by limiting or discontinuing certain features of the Service, without notice. We will have no liability whatsoever on account of any change to the Service or any suspension or termination of your access to or use of the Service. Failure by Jurne Di Mare Travel LLC, to enforce any of its rights under this Agreement shall not be construed as a waiver of those rights or any other rights whatsoever.
The Service is owned and operated by us, Jurne Di Mare Travel, LLC, d/b/a JDMT. In accordance with Digital Millenium Copyright Act (“DMCA”) and other applicable law, Jurne Di Mare Travel has adopted a policy of terminating subscribers or subscribers’ account who are repeat infringers. We may also limit or restraint access to all or part of our services and/or terminate the account of any user who infringes any intellectual property rights of others, whether or not there is any repeat infringement.

Infringement of any type will violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these T/C shall be construed as conferring any access to intellectual property rights, whether by principle, implication or otherwise. Access is revocable by us at any time without notice and with or without cause. You may not:
1) Modify, Disclose, alter, translate or create derivative works of the Services or any contents of the Services.
2) License, Sublicense, resell, distribute, lease, rent, lend, transfer, assign or otherwise dispose of the Services.

All content, except for some Third-Party service providers’ content, is the property of Jurne Di Mare Travel LLC. Except as expressly authorized by Jurne Di Mare Travel in these Terms, you may not make use of the materials/service. Information, or material, content of Services, including text, graphics, data, format, graphs, designs, HTML, look, and feel, photographs, music, sounds, logos, visual interfaces, graphics, trademarks, images design, compilation, information, data, computer code (including promotional materials, source code or object code), products, software, algorithms, services, and all other elements of material/services provided is owned by Jurne Di Mare Travel, or with prior approval of affiliate or Third Party service provider has been included on our Site and therefore protected by all relevant intellectual property and proprietary rights and applicable laws.
For clarification, Downloadable Content includes content of designated services that Jurne Di Mare Travel specifically designates on the Services as available for download, even though you may copy or download other content through the web browser or by other means. Downloadable Content does not include any software that Jurne Di Mare Travel may allow you to download from any services (the use of software is governed by the agreement you accept when download, install, register or use such software). You may not use Downloadable content for any business or other commercial purposes (Business or commercial purposes does not exclude use for purposes of seeking employment through the Services) without our prior written approval. All goodwill arising from Downloadable Content will inure solely to the benefit of Jurne Di Mare Travel. We may terminate your license at any time.
Jurne Di Mare Travel’ prides itself by forging strong professional business relations with all of our customers, clients, travel partners, affiliates, supplier, vendors, etc. by conducting business in a respectful manner through honesty and integrity, and ultimately to build strong bond and loyalty among all of our clients and business partners. We understand certain events may arise from misunderstandings, or disagreements between us, our clients, or (Traveler, Agents, Third party service providers, affiliates, vendors, etc.,). In order to provide a mutually beneficial solution and try to heal business relationships and rebuild trust among all parties, Jurne Di Mare Travel’s approach is to first look for other positive resolutions via negotiations. At times it may be challenging to find common ground, however, if both client or Jurne Di Mare, or Third Party, or other entity(s), feel irreconcilable differences exist due to circumstances such as Breach of Contract or breach of any kind, or any other circumstances that lead to mistrust in conducting business with each other, or for not being able to agree on negotiating the matter in good faith, both parties agree to try settle first through confidential mediation before resorting to arbitration, litigation, or some other dispute resolution procedure. Shall parties enter into confidential mediation and not succeed nor agree on a resolution, then all involved parties will settle by binding arbitration in Miami Dade County Court, Florida, USA in accordance with the Streamlined Arbitration Rules and Procedures (“Rules”) of the Judicial Arbitration and Mediation Services (“JAMS”). Any claims or disputes where the total amount of the award sought is above Five Thousand U.S. Dollars (US $5,000.00) shall be resolved through binding non-appearance- based arbitration. For claims or disputes where the total amount of the award sought is Five Thousand U.S. Dollars (US $5000.00) or less shall be subject to small claim jurisdiction in Miami Dade court in Florida. We (or any future holder, as the case may be) shall pay the administrator’s hearing fees for half of the first day of arbitration hearings. Fees for hearings that exceed one full day will be paid by the party requesting the hearing, unless the administrator’s rules or applicable law require otherwise, or you request that we (or the future holder) pay them, and we agree (or any future holder agrees) to do so. Each party shall bear the expense of its own attorneys’ fees, except as otherwise provided by law. If a statute gives you the right to recover any of these fees, these statutory rights shall apply in the arbitration notwithstanding anything to the contrary herein. If a qualified mediator or arbitrator is unavailable, all involved parties agree to a mutually acceptable dispute resolution service.
RELEASE DISCHARGE /HOLD HARMLESS AGREEMENT Client acknowledges having carefully read the above paragraphs and fully agree to all stated conditions therein. I_________hereby EXPRESSLY AGREE TO PERMANTELY AND IN PERPETUITY RELEASE, DISCHARGE AND HOLD Jurne Di Mare Travel, LLC, d/b/a JDMT and its agents, any of their respective members, consultants, employees, officers, directors, managers, associates, suppliers, affiliated companies, subsidiaries, and subcontractors, service providers, promotion agencies, and any other JDMT Company, HARMLESS from ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTIONS, SUITS, PENALTIES, FINES, DEBTS, LOSSES OR DAMAGES (COLLECTIVELY, "CLAIMS") ARISING OUT OF USE OF THE WEBSITE OR CONTENT, including BUT NOT LIMITED TO PERSONAL INJURY, DEATH OR DAMAGE TO OR LOSS OF PROPERTY, YOUR INTERACTION WITH ANY OTHER USERS OR YOUR USE OF MATERIALS SUBMITTED BY OTHER USERS; and ANY and ALL CLAIMS WHICH YOU MAY OR CAN HAVE IN CONNECTION WITH IDEA SUBMISSIONS, YOUR SUBMISSIONS, INCLUDING, WITHOUT LIMITATION, ANY AND ALL LIABILITY FOR ANY USE OR NON-USE OF IDEA SUBMISSIONS, YOUR SUBMISSIONS OR OTHER CONTENT, CLAIMS FOR DEFAMATION, FALSE INSINUATION, SLANDER, INVASION OF PRIVACY, RIGHT OF PUBLICITY, DIRECT OR INDIRECT TRADEMARK INFRINGEMENT, UNFAIR COMPETITION, DIRECT OR INDIRECT COPYRIGHT INFRINGEMENT, PSYCHOLOGICAL HARM, EMOTIONAL DISTRESS OR ECONOMIC LOSS, ALL LIABILITY OF AND ANY KIND, EVERY KIND AND NATURE WHICH I NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH MY TRIP OR PARTICIPATION IN ANY ACTIVITIES OR SERVICES ARRANGED FOR ME, by Jurne Di Mare Travel and its agents, members, officers, managers, employees, associates, suppliers, affiliated companies, or subcontractors. Terms of this AGREEMENT SERVES AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK to me, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me. I HAVE READ AND FULLY UNDERSTAND ALL THE PROVISIONS AND STATEMENTS ON THIS AGREEMENT AND THE LEGAL IMPLICATIONS OF THIS RELEASE AND ASSUMPTION OF RISK, AND I , hereby AGREE TO ALL OF IT. In addition, I___________, acknowledge that Jurne Di Mare Travel, has suggested I have a legal expert advice review this release prior to my signing. I further agree that any legal dispute involving travel services terms, or actions, is subject to the FRIENDLY DISPUTE RESOLUTION PROVISION herein. IF in the event of any legal action shall necessitate the use of a court(s) the action shall be heard only by the courts of Miami Dade County, Florida, U.S.A.
You expressly waive any rights you may have under California Civil Code § 1542, as well as any other statue or common law principles that would otherwise limit coverage of this release to include only those you may know or suspect to exist in your favor at the time of agreeing to this release. Furthermore, I _____________acknowledge that in calculating the cost of the arranged trip services, Jurne Di Mare Travel has relied on my consent to these terms and on their enforceability. In the absence of this Release, the trip cost would have been higher, or, alternatively, Jurne Di Mare Travel, would be unable to offer services to me. I, _____________ fully understand this is a legally binding and enforceable agreement and I sign it of my own free will. I, ________agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
ALL parties further agree that any disputes or claims related to any of our terms of services, rules, or any content hereby presented MUST BE FILE within 30 days after claim arose, OTHERWISE the claim is permanently barred. Breach of contract, negligence, etc., will solely be brought through confidential Individual Arbitration basis and binding arbitration. Arbitration may Not be as a Class Action Arbitration, Collective Class Action Arbitration, or on a Group, Representative, Consolidated, or Joint Basis, or any other type of Arbitration. You AGREE, YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER FOR ANY CLAIM COVERED BY THIS AGREEMENT. THE PARTIES WAIVE ANY RIGHT TO A TRIAL BY JURY OF A COVERED DISPUTE OR TO HAVE A COVERED DISPUTE BE DECIDED BY A COURT OR JURY. Fees for arbitration hearings that exceed one full day will be paid by the party requesting the hearing, unless the administrator’s rules or applicable law require otherwise, or you request that we (or the future holder) pay them, and we agree (or any future holder agrees) to do so. Each party shall bear the expense of its own attorneys’ fees, except as otherwise provided by law. If a statute gives you the right to recover any of these fees, these statutory rights shall apply in the arbitration notwithstanding anything to the contrary herein. If a qualified mediator or arbitrator is unavailable, all involved parties agree to a mutually acceptable dispute resolution service. Costs fees may include filing, JAMS fees, arbitrator fees, etc.
Jurne Di Mare Travel L.L.C, d/b/a JDMT or any of its affiliates shall exclusively resolved by final and binding arbitration under the JAMS Streamlined or Comprehensive Arbitration Rules and Procedures, ONLY IF the matter cannot be resolve by previously stated AMICABLE DISPUTE RESOLUTION ALTERNATIVE. These Terms affect interstate commerce and enforceability of this Section. 14 will be substantively and procedurally governed by the Florida Arbitration Code, Fla. Stat. §682 (“the FAC”), to the maximum extent permitted by applicable law.
Enforcement of these Terms is solely at the discretion of Jurne Di Mare Travel L.L.C, d/b/a JDMT. The failure to enforce any part of these Terms in some instances does not constitute a waiver of our right to enforce the same or other part of these Terms in other instances. Shall any provisions of these Terms be or becomes unlawful, void, or otherwise unenforceable, then that provision will be deemed superseded by a valid, enforceable provision that closely matches the intent of the original provision, and the remaining provisions of these Terms will continue be in full force and in effect indefinitely or until otherwise changed.
– Any suggestions, comments, or other feedback you provide us about the Service or any of Jurne Di Mare Travel’s products or content here presented will be confidential information. We are free to use, disclose, reproduce, license, distribute, and exploit this feedback information as we see fit, without compensation to you or any obligation or restriction because of any intellectual property rights or otherwise.
You agree to defend, indemnify, and hold harmless Jurne Di Mare Travel, its affiliates, and their respective directors, officers, employees, agents and representatives (collectively, Jurne Di Mare Travel’s Third-Party service providers and/or affiliates) from and against any claims, damages, losses, liabilities, costs of any kind, expenses of any kind, (including due to attorney’s fees) arising out of your use of the Services, including without limitation any actual or threatened suit, demand or claim arising out of your violation of these TC (Terms Conditions) or your violation of the rights of any Third Party/or affiliated.
THE SERVICES AND ANY CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES (INCLUDING THIRD PARTY MATERIALS) ARE PROVIDED TO YOU ON AN AS-IS BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. WE DISCLAIM ANY AND ALL OTHER WARRANTIES AND REPRESENTATIONS (EXPRESS OR IMPLIED, ORAL OR WRITTEN) WITH RESPECT TO THE SERVICES AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES (INCLUDING THIRD PARTY MATERIALS) WHETHER ALLEGED TO ARISE BY OPERATION OF LAW, BY REASON OF CUSTOM OR USAGE IN THE TRADE, BY COURSE OF DEALING OR OTHERWISE.
These Terms will be governed by and construed and enforced in accordance with the laws of the State of Florida and the U.S, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to this Agreement will be file only in the state courts located in Miami Dade County, Florida, USA, and you hereby irrevocably and unconditionally consent and submit the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms.
